Rivalmaker Referral Giveaway - Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  

1. Sponsor: The Rivalmaker Referral Giveaway ("Giveaway") is sponsored by Rivalmaker LLC ("Sponsor").

2. Eligibility: The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and who are registered users of the Rivalmaker platform ("Platform") prior to the start of the Giveaway Period (defined below). Entrants must be actively employed as a coach or staff member associated with a division 1 collegiate women's basketball program. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the "Employees"), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.  

3. Agreement to Rules: By participating, the Contestant ("You") agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to the content of this Giveaway.  

4. Giveaway Period: Entries will be accepted starting on May 1, 2025, at 12:00:01 AM Eastern Daylight Time (EDT) and ending on June 22, 2025, at 11:59:59 PM EDT (the "Giveaway Period"). All Successful Referrals (as defined below) must be completed within the Giveaway Period.  

5. How to Enter: To enter the Giveaway, eligible individuals must perform the following actions during the Giveaway Period: 

a. Be an Eligible User: You must be an eligible, registered user of the Rivalmaker platform as defined in Section 2. 

b. Follow on X: You must follow the official Rivalmaker account on X (formerly Twitter) located at @Rivalmaker (https://twitter.com/Rivalmaker). Your X account used to follow must be verifiable as belonging to You upon request by Sponsor. 

c. Refer New Programs: Refer eligible, new women's basketball programs ("Referred Programs") to sign up for Rivalmaker's free scheduling tool. A "New Program" is defined as a division 1college or university women's basketball program that does not have any coach or staff member registered as a user on the Rivalmaker platform prior to the start of the Giveaway Period. 

d. Ensure Referral Credit: You must ensure that the Referred Program mentions your full name and your affiliated institution as the source of the referral when they sign up for the Rivalmaker platform or during initial communication with Rivalmaker staff regarding their sign-up. Sponsor will attempt to verify referrals but ultimate responsibility for ensuring the referral is properly attributed lies with the entrant and the Referred Program.

6. Successful Referral Definition: A "Successful Referral" is counted when: a. The Referred Program meets the definition of a "New Program". b. At least one coach or staff member from the Referred Program successfully registers for the free Rivalmaker tool during the Giveaway Period. c. The Referred Program accurately identifies You (by full name and institution) as the referrer through the method specified by Sponsor (see Section 5d) during the Giveaway Period. Multiple sign-ups from the same New Program count as only one (1) Successful Referral for the purposes of this Giveaway. Sponsor reserves the right to verify the validity of all referrals and registrations.

7. Winner Selection and Notification:

 a. Selection: The eligible entrant who accumulates the highest number of verified Successful Referrals during the Giveaway Period will be deemed the potential winner. 

b. Tie-Breaker: In the event of a tie for the highest number of Successful Referrals, the entrant among the tied participants whose last Successful Referral was completed earliest (based on the timestamp of the referred user's sign-up and successful attribution) during the Giveaway Period will be deemed the potential winner. 

c. Notification: The potential winner will be notified via the email address associated with their Rivalmaker account within approximately seven (7) business days following the end of the Giveaway Period (on or around July 1, 2025). Sponsor shall have no liability for Winner's failure to receive notices due to spam, junk e-mail or other security settings or for Winner's provision of incorrect or otherwise non-functioning contact information. If the potential winner cannot be contacted, is ineligible, fails to claim the prize within five (5) calendar days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as may be required, the prize may be forfeited and an alternate winner selected based on the next highest number of Successful Referrals (applying the tie-breaker rule if necessary).  

8. Prize: One (1) winner will receive one (1) $75 Gift Card of winners choosing. The Approximate Retail Value (ARV) of the prize is $75 USD. The specifics of the prize shall be solely determined by Sponsor. No cash or other prize substitution shall be permitted except at Sponsor's discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Acceptance of prize constitutes permission for Sponsor to use Winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.  

9. General Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor's control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Sponsor may select the Winner from all eligible entries/referrals received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.  

10. Limitation of Liability: By entering, You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.  

11. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND Virginia, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Nelson County having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney's fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). Participant further waives all rights to have damages multiplied or increased.
